These Terms of Service govern your use of our website and B2B sales transactions for ASTM F136 certified titanium piercing jewelry.

1. Definitions and Scope

Definitions:

  • "Company," "we," "us," "our" refers to F136 Titanium Piercing, a titanium piercing jewelry manufacturer located in Dongguan, Guangdong, China.
  • "Buyer," "you," "your" refers to the business entity or professional purchasing our products.
  • "Goods" refers to ASTM F136 and Grade 23 titanium piercing jewelry products.
  • "Ready Stock" refers to pre-manufactured items available for immediate shipment.
  • "Made-to-order" refers to custom manufactured items per buyer specifications.
  • "Business Day" refers to Monday through Friday, excluding Chinese national holidays.

Scope: These terms apply to all website usage, inquiries, quotations, orders, and sales transactions between the Company and professional buyers.

2. Website Usage Terms

Acceptable Use: You may not:

  • Use automated systems to scrape, copy, or extract website content
  • Submit false information or create fraudulent accounts
  • Interfere with website functionality or security
  • Use content for unauthorized commercial purposes

Account Registration: If account creation is available, you must provide accurate business information. We reserve the right to suspend accounts that violate these terms.

Content Accuracy: Product specifications, images, and technical data are for reference only. Final specifications are determined by mutually confirmed drawings, samples, or specification sheets.

3. B2B Professional Use Only

Professional Buyers Only: Our products are intended for professional piercing studios, jewelry brands, distributors, and qualified business entities.

Business Verification: We may require business registration documents, professional licenses, or other verification before processing orders.

Right to Refuse: We reserve the right to decline orders from unverified businesses or suspicious purchase requests.

4. Quotations, Orders and Contract Formation

Quotation Validity: All quotations are valid for 30 days unless otherwise specified. Prices are in USD and exclude shipping unless stated otherwise.

Order Confirmation: Orders become binding only upon our written Order Confirmation or Proforma Invoice.

Specification Confirmation: Final specifications are based on mutually confirmed drawings, samples, or specification sheets. Unconfirmed details default to our standard specifications.

Minimum Order Quantities:

  • Ready Stock: 10 pieces per item
  • Custom/OEM/ODM: 200 pieces per item

5. Pricing, Payment and Taxes

Payment Methods: We accept T/T (wire transfer), PayPal for business accounts, and other mutually agreed payment methods.

Payment Terms:

  • Ready Stock: 100% payment before shipment
  • Custom Orders: 50% deposit, 50% balance before shipment
  • Large Orders: Payment terms subject to credit approval

Late Payment: Overdue payments may incur 1.5% monthly service charges. We may suspend shipments for accounts in arrears.

Taxes and Duties: Buyer is responsible for all import duties, taxes, and customs clearance in destination country unless DDP terms are agreed.

6. Delivery, Shipping and Risk Transfer

Delivery Terms: Standard terms are EXW (Ex Works) Dongguan, China. FOB, CIF, or DDP terms available upon request with adjusted pricing.

Lead Times:

  • Ready Stock: 3 business days
  • Custom/OEM Production: 40-60 days
  • Sampling: 10-25 days depending on complexity

Risk Transfer: Risk transfers according to agreed Incoterms. For EXW terms, risk transfers when goods are made available at our factory.

Delays: Lead times are estimates. We are not liable for delays due to force majeure, shipping disruptions, or circumstances beyond our control.

7. Quality Control, Inspection and Claims

Inspection Period: Buyer must inspect goods and report quantity discrepancies or obvious defects within 2 business days of receipt.

Claim Documentation: Claims must include photos, videos, batch numbers, and detailed descriptions. Third-party inspection reports may be required for complex claims.

Resolution Options: Validated claims may be resolved through replacement, rework, discount, or refund at our discretion.

Non-Quality Returns: Custom/OEM items, used products, or items damaged during installation are not returnable unless due to manufacturing defects.

8. Material Standards and Limited Warranty

Material Compliance: Our products are manufactured from ASTM F136 and Grade 23 (Ti-6Al-4V ELI) titanium conforming to published material standards. Material certificates and batch traceability documents are available upon request.

Limited Warranty: We warrant that products will:

  • Conform to confirmed specifications and drawings
  • Meet stated dimensional tolerances
  • Be free from manufacturing defects
  • Comply with material standard documentation

Important Disclaimers:

  • We provide materials conforming to published standards but make no medical claims or treatment guarantees
  • Professional buyers are responsible for proper sterilization, installation, and end-user guidance
  • We do not provide medical advice - information provided is general reference only
  • Individual allergic reactions or biocompatibility issues are excluded from warranty

9. Limitation of Liability

Liability Exclusions: We are not liable for:

  • Indirect, consequential, or incidental damages
  • Lost profits or business interruption
  • End-user misuse or improper installation
  • Inadequate sterilization or aftercare
  • Individual allergic reactions or complications

Liability Cap: Our total liability for any order shall not exceed the amount paid for that specific order or batch.

Professional Responsibility: Buyers acknowledge they are responsible for ensuring proper use, installation procedures, and compliance with local regulations.

10. OEM/ODM Special Terms

Development Fees: Sampling, tooling, and NRE fees are non-refundable unless otherwise agreed. Fees may be credited against production orders meeting minimum quantities.

Sample Approval: Approved samples establish production standards. Production tolerances follow industry standards or agreed specifications.

Customer IP Protection: Customer trademarks and designs are used solely for order fulfillment unless written permission is granted for promotional use.

IP Indemnification: Customer warrants that provided designs, trademarks, and specifications do not infringe third-party rights and indemnifies us against related claims.

Custom Packaging: Customer is responsible for ensuring custom packaging and labeling comply with destination market regulations.

11. Intellectual Property

Our Content: Website content, product images, technical specifications, and downloadable materials are our property and protected by copyright.

Usage Restrictions: Content may not be copied, redistributed, or used commercially without written permission.

Customer Materials: Customer-provided logos, designs, and specifications are used solely for order fulfillment unless promotional use is specifically authorized.

12. Compliance and Export Controls

Import Compliance: Buyer warrants compliance with all applicable import regulations, professional licensing requirements, and age restrictions in destination markets.

Export Controls: We comply with applicable Chinese export regulations. Buyer is responsible for import clearance and compliance.

Restricted Orders: We reserve the right to decline orders that may violate export controls or sanctions regulations.

13. Force Majeure

Events: Neither party is liable for delays or failures due to circumstances beyond reasonable control, including:

  • Natural disasters, pandemics, or public health emergencies
  • War, terrorism, or civil unrest
  • Government actions or regulatory changes
  • Port congestion or shipping disruptions
  • Supplier failures or material shortages

Notification: Affected party must promptly notify the other party and use reasonable efforts to minimize impact.

14. Dispute Resolution

Governing Law: These terms are governed by the laws of the People's Republic of China, excluding conflict of law principles.

Dispute Resolution: Disputes shall be resolved through binding arbitration under the China International Economic and Trade Arbitration Commission (CIETAC) rules in English language.

Language Priority: In case of conflicts between English and Chinese versions of these terms, the English version shall prevail.

15. General Provisions

Term Updates: We may update these terms by posting revised versions on our website. Continued use constitutes acceptance of updated terms.

Severability: If any provision is found unenforceable, the remaining provisions continue in full force.

Entire Agreement: These terms, together with order confirmations and specifications, constitute the complete agreement between parties.

Assignment: These terms may not be assigned without written consent, except we may assign to affiliates or in connection with business transfers.
